Xbox 360 Scratched Disc Caused Consumer to Take Microsoft
to Court
Xbox 360 is a video game console and the most popular for your information. It is reputed for
the improvement features that it has shown when compared against those that offer similar opportunities. But,
like any other thing, this achievement has not just
come with no challenges. The challenges that Xbox 360 has are quite many. One of them is the Xbox 360
scratched disc issue - that sometimes you may attempt to insert your disc which would have the games you wish
to play and then it does not go in well. This can get the disc scratched and equally rendering it all
useless.
In a recent report, we encountered someone who got so ticked off with the Xbox 360 scratched
disc and took some action. To this consumer, it was like Microsoft was not taking seriously their obligation to
provide quality gaming opportunities to their clients and so he ended up suing both Microsoft and Xbox 360. But,
Microsoft is not the first and they are not the last of the video game console manufacturers to be sued.
What the problem is
The case of this consumer against Microsoft is that they repeatedly damaged and scratched their
discs. The worst and the most biting part of the Xbox 360 scratched disc case was that the discs were now
useless, they could not play again. Incidentally, only a year back before this case, a different consumer
had sued Microsoft with the same allegations of getting their discs scratched. This is a technical default in
fact.
It is surprising what this consumer did. He never thought about the cost of his
action. He would have easily replaced the discs with only a few dollars or even bought a new console at a
lower rate. But instead, he chose to have this case mentioned and heard in court so that he could have
Microsoft charged for $50000.
His reasoning was that the $50,000 would pay for the Xbox 360 scratched disc damages he incurred
and the legal expenses he also incurred. One would be tempted to think like I do that the fee would be used for
supplying more of the Xbox 360 consoles and several video games.
Xbox 360 Scratched Disc – Microsoft in a tight
spot
But, Microsoft would need to assess the situation first before they take any action. Whatever
action they take would work for or against them. It is either they find a way of dealing with the allegations
different from having to pay the $50k or they get themselves in an awkward situation.
There would be many more of such Xbox 360 scratched disc cases if they decided to make the
payment. There are so many other angry customers who are getting their discs scratched and damaged just the same
way this customer did. $50,000 is not a bad sum, you can do so much with it and so you would not mind getting
it.
The result is therefore likely to be so many other lawsuits and the consumers would be asking
for the same kind of compensation. If Microsoft chooses to do it for this one consumer, they will not have a
justification for refusing to do the same for all the many others who will also need to get the same
compensation.
The customer service department of Microsoft would not have peace. The consumers would all be
complaining and the reason would be obvious. They will be having an Xbox 360 scratched disc complaint alongside
a suggestion on the kind of remedy they would be expecting. So, this is the right time when Microsoft can make a
decision on what they wish to have in future. It is best to listen to their customers and certainly the best way
is not through paying the $50,000 that has been requested by the above consumer.
